The court concluded that Njoroge's robbery with violence charge is unlawful since section 96 (2) of the Penal Code, which is the basis for the offence, was pronounced unconstitutional by the High Court.


The court also stated that the prosecution's argument that Njoroge not be released on bail or bond because he is a flight risk is unrealistic because it is not backed by facts.

On Wednesday, the prosecution sought the court to refuse Njoroge bail/bond, citing, among other things, an alleged imminent threat to his safety as a result of the significant public outrage that followed the occurrence.


"That due to the publicity surrounding the case, the atmosphere on the ground is unfavorable to the accused person. In an affidavit, DCI Investigating Officer Josephat Rotich stated that the accused is in imminent danger as a result of public agitation.

The prosecution also underlined Njoroge's propensity to tamper with witnesses if he were released.

"The accused person is likely to meddle with crucial witnesses. "Some of whom were captured on social media and are physically well known to the accused," the prosecution claimed.

Furthermore, Rotich stated that Njoroge never turned himself in after attacking the police officer, indicating that he is a flight risk.


"After the event, the accused did not report to the station, but instead went into hiding until he was discovered by officers and arrested. As a result, he poses a flight risk, according to the DCI investigator.

Rotich noted that the police officer attacked by Njoroge wishes to testify before the culprit is granted bail.

"The complainant, who is 57 years old, feels attacked on social media and wants to testify before the accused is released. I understand that bail and bond are constitutional rights, but they can be rejected if there are sufficient reasons," he stated.


"I have been informed by the counsel handling the information which I believe is true that the reasons given are compelling enough so as to deny the respondent person bond."

The city politician Mike Sonko offered to help the boy by bailing him and working with his lawyer.
