Babu Owino to pay a fine of KES 10K if found guilty of shooting DJ Evolve

A Nairobi court has ruled that Embakasi East MP Babu Owino must answer charges stemming from the alleged misuse of a firearm at a Nairobi nightclub.  

On the night of January 17, 2020, at B-Club, the lawmaker was charged with being disorderly while carrying a gun and firing one bullet with the intent to shoot DJ Evolve. There is sufficient evidence Milimani Senior Principal Magistrate Bernard Ochoi ruled in his ruling that the prosecution had enough evidence to put Babu on the stand.  

Ochoi stated that he was satisfied that the prosecution had built a solid case against the ODM MP. He dismissed the legislator's contention that the prosecution had failed to prove the allegation.

The prosecution claimed that the second-term lawmaker violated Sections 33 and 31 (1) of the Firearms Act, which could result in a year in prison or a KSh 10,000 fine if found guilty. The case's hearing will begin on June 15. The legislator is currently out on bail. 

Withdrawing attempted murder charge

The attempted murder charge has been dropped. The court granted DJ Evolve's request to withdraw the attempted murder charge against the MP in 2022, but upheld the second count of firearm misuse. Ochoi stated that Babu and Evolve were friends prior to the incident and have remained so even after the unfortunate incident.  

Prior to the ruling, an agreement between Babu and the DJ was filed as a condition for the case to be dropped. 

The agreement's conditions and properties include settling the hospital bill, purchasing two houses, a vehicle, and establishing a DJ academy.
